Creator Agreement

This Creator Agreement (“Agreement”) is entered into between Upperstage Eng Ltd, a company registered in Cyprus under number HE155422 and trading as “AlbumSelection” (“AlbumSelection,” “we,” “us,” or “our”), and the individual creator submitting the Creator application form (“Creator,” “you,” or “your”).

By submitting the Creator application / confidentiality form on AlbumSelection.com, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement. Your online submission constitutes your electronic signature.

1. Purpose of this Agreement

   AlbumSelection acquires non-exclusive rights to use, display, promote, and monetize content that you create (“Content”) on the website www.albumselection.com and on associated promotional channels. This Agreement governs how that Content is used, how you are compensated, and the rights and responsibilities of both parties.

2. Eligibility and Creator Verification

   To participate as a Creator, you confirm that:

   • you are at least 18 years old (or the age of majority in your jurisdiction, if higher);
   • you are legally allowed to appear in and license adult or suggestive content;
   • you have provided accurate information in the Creator form, including your real name, age and country;
   • you will provide a valid government-issued identity document if requested; and
   • you will cooperate with reasonable identity and age verification checks.

   AlbumSelection may, at its discretion, request additional verification (for example a liveness check or selfie with your ID) where we consider it necessary. We may refuse or terminate your participation if verification fails or appears inconsistent.

3. Non-Exclusive License to AlbumSelection

   You grant AlbumSelection a non-exclusive, worldwide, transferable and sublicensable license to:

   • use, host, store and display your Content on the Website;
   • reproduce, distribute and make your Content available to paying users;
   • crop, edit, retouch or otherwise adapt your Content (see section 10); and
   • create derivative works such as previews, thumbnails, banners and promotional clips.

   This license applies to all Content you submit or deliver to AlbumSelection in connection with the platform, including photos, videos, descriptions, captions and profile information.

4. Optional Exclusivity for Specific Content

   By default, Content is licensed to AlbumSelection on a non-exclusive basis and you may use it elsewhere. However, for particular albums or sets where AlbumSelection offers an enhanced rate, we may designate that Content as Exclusive Content. If we do so in writing (for example by email or contract addendum):

   • you agree not to publish, sell or license that specific Exclusive Content elsewhere during the agreed term; and
   • exclusivity applies only to the clearly identified Exclusive Content, not to all of your work.

5. License Duration and Auto-Renewal

   For each piece or set of Content, you grant AlbumSelection the rights described in this Agreement for a minimum period of one (1) year starting from the date the Content is first published on the Website.

   After this initial year, the license will automatically renew for additional one-year periods unless you request removal of that Content. If you request removal after the first year:

   • AlbumSelection will remove the Content from the Website within a reasonable period, not exceeding 30 days; and
   • AlbumSelection may retain or continue to use promotional materials already created (for example collages, thumbnails, banners or teaser videos) that incidentally include that Content.

6. Compensation and Independent Contractor Status

   AlbumSelection compensates Creators on a per-case basis. This means that rates may vary between Creators and between projects, depending on factors such as content quality, sales potential, niche, and platform performance.

   Nothing in this Agreement obliges AlbumSelection to:

   • offer a minimum number of projects or purchases; or
   • pay a fixed salary or minimum monthly amount.

   Any payment terms agreed with you (for example per set or per month) are separate commercial terms and may be revised for future work. You act as an independent contractor, not an employee. You are responsible for your own taxes, social contributions and compliance with local laws.

7. AlbumSelection Sets All End-User Pricing

   AlbumSelection is the sole publisher and merchant of record for all sales to users of the Website. You understand and agree that:

   • AlbumSelection sets all prices for subscriptions, albums, bundles and any other paid features;
   • AlbumSelection may change prices, run discounts or promotions and create upsells or downsells at its discretion; and
   • users never pay you directly and you have no direct financial transaction with them through the Website.

8. Promotional Use of Your Image and Content

   You grant AlbumSelection the right to use your Content, stage name, likeness, profile images and biographical text for promotional and marketing purposes related to the Website. This includes, for example:

   • thumbnails and banners on the Website;
   • email or on-site promotions;
   • social media or advertising creatives; and
   • editorial features highlighting Creators.

   No additional payment is due for such promotional use beyond the compensation agreed for the Content.

9. Content Standards and Right to Reject

   AlbumSelection may review Content before or after publication and may reject, remove, or request resubmission of Content that in our reasonable opinion:

   • is low quality (for example heavily blurred, poorly lit or heavily pixelated);
   • does not fit the style or standards of the Website;
   • appears to involve minors or non-consenting persons;
   • contains illegal material, or incites illegal activity;
   • uses copyrighted material you do not own; or
   • otherwise violates our Terms of Service, Acceptable Use Policy or applicable law.

   AlbumSelection’s decision regarding approval or rejection of Content is final.

10. Editing, Retouching and Modifications

    You consent to AlbumSelection editing, adapting and enhancing your Content for presentation and marketing purposes, including:

    • cropping or resizing;
    • color correction and light adjustments;
    • basic retouching (for example background cleanup);
    • adding branding, borders or watermarks; and
    • creating short clips, teasers or compilations from longer content.

    Such edits do not change your underlying ownership of the original Content, but they remain part of the licensed material that AlbumSelection can use under this Agreement.

11. Creator Warranties and Legal Compliance

    You represent and warrant that for all Content you provide:

    • you are the creator or lawful rights holder of the Content, or you have all rights necessary to grant this license;
    • all individuals depicted were at least 18 years old at the time of recording;
    • you have obtained valid consent and, where appropriate, model releases for all persons shown;
    • the Content does not infringe any copyright, privacy, publicity or other third-party rights;
    • the Content does not include minors (real or simulated), bestiality, non-consensual acts, or any form of trafficking or exploitation; and
    • you will not submit stolen, “revenge porn,” or deceptive AI images of real persons.

    You agree to indemnify AlbumSelection against any claim, loss, or damage arising from a breach of these warranties.

12. Confidentiality

    You agree to keep confidential and not disclose to any third party, without our prior written consent:

    • internal payment rates, pricing structures or strategies;
    • any non-public tools, scripts, templates or training materials we provide;
    • details of our internal operations, processes or plans; and
    • the content of non-public communications between you and AlbumSelection.

    This confidentiality obligation continues to apply even after your collaboration with AlbumSelection ends.

13. Termination

    AlbumSelection may suspend or terminate your collaboration and disable your profile if:

    • you breach this Agreement or the Website’s Terms of Service;
    • you submit illegal or prohibited Content;
    • you fail or refuse reasonable verification checks; or
    • your actions damage or risk damaging AlbumSelection’s reputation or legal position.

    In serious cases, AlbumSelection may withhold unpaid amounts and report suspected illegal conduct to relevant authorities. Subject to the minimum license term in section 5, AlbumSelection may continue using Content already licensed for the remainder of the agreed period.

14. Independent Contractor

    Nothing in this Agreement creates an employment, partnership or joint venture relationship between you and AlbumSelection. You act as an independent contractor and are responsible for your own taxes, social security contributions and compliance with local laws.

15. Governing Law

    This Agreement is governed by the laws of Cyprus. Any disputes arising out of or in connection with this Agreement will be subject to the jurisdiction of the courts of Cyprus, unless otherwise required by mandatory law.

16. Digital Acceptance and Appendix A

    By submitting the Creator application / confidentiality form on AlbumSelection.com you agree that:

    • this Agreement is binding as if signed with a handwritten signature; and
    • the personal details you provide in the form form part of Appendix A – Creator Details to this Agreement.

    Appendix A typically includes: your full name, email address, age, country, social media handles, and submission date, as provided by you through the form.
